CASA IS A DESIGNATED RECIPIENT OF CY PRES FUNDS

California Code of Civil Procedure §384 specifically identifies "child advocacy programs" as proper recipients of residual class action funds. Court Appointed Special Advocates ("CASA") of Ventura County, which trains community volunteers to advocate for foster children, is our county's primary child advocacy program for foster youth. Our trained advocates stand up for abused and neglected children in court and in our community. These children are crime victims. [Probate Code §272(a).] The CASA program is defined in the Welfare and Institutions Code and CASA of Ventura County is under the jurisdiction of the Ventura County Superior Court. The purpose of California's cy pres statute is "to promote justice for all Californians." [CCP §384(a).] By choosing CASA of Ventura County, class action parties are ensuring justice for our most vulnerable population- abused and neglected children.

Please propose CASA of Ventura County for your cy pres distribution. The award can be directly incorporated into the class action settlement agreement and CASA of Ventura County will work with counsel to prepare the necessary documentation.
