Cy Pres Distributions
CASA of Ventura County is an eligible recipient of cy pres funds under California law. The California Code of Civil Procedure §384 specifically identifies child advocacy programs as appropriate beneficiaries of residual class action funds. CASA of Ventura County is our county’s primary child advocacy program for foster youth, defined under the Welfare and Institutions Code and operating under the jurisdiction of the Ventura County Superior Court.
Our trained volunteers stand up for abused and neglected children—crime victims under Probate Code §272(a)—by advocating for their best interests in court and in the community. Directing cy pres funds to CASA ensures these children receive the advocacy and support they deserve, in keeping with the statute’s purpose “to promote justice for all Californians” [CCP §384(a)].
By naming CASA of Ventura County in your class action settlement, you ensure justice for our most vulnerable population. Awards can be incorporated directly into settlement agreements, and CASA will work with counsel to provide any required documentation.
